{"id":3125,"date":"2020-06-28T22:56:39","date_gmt":"2020-06-29T05:56:39","guid":{"rendered":"http:\/\/www.usdmootcourt.com\/?page_id=3125"},"modified":"2023-08-04T13:05:51","modified_gmt":"2023-08-04T20:05:51","slug":"2020-ncpt","status":"publish","type":"page","link":"https:\/\/www.usdmootcourt.com\/tournaments\/national-criminal-procedure-tournament\/2020-ncpt\/","title":{"rendered":"2020 National Criminal Procedure Tournament"},"content":{"rendered":"<p><strong>The 32nd Annual National Criminal Procedure Tournament has concluded and the results can be found here: <a href=\"http:\/\/www.usdmootcourt.com\/tournaments\/national-criminal-procedure-tournament\/results\/2020-results\/\"><span style=\"text-decoration: underline; color: #0074c8;\">2020 Results<\/span><\/a><\/strong><\/p>\n<p>The University of San Diego of Law\u2019s Appellate Moot Court board cordially invites you to compete in the 32nd Annual National Criminal Procedure Tournament. <strong>USD will hold the 2020 National Criminal Procedure Tournament <em>remotely<\/em> this year on <span style=\"color: #ff0000;\">November 6 through November 8<\/span>.&nbsp;<\/strong><\/p>\n<h3 style=\"margin-bottom: 0px;\"><span style=\"font-size: 14pt; color: #003b70;\"><strong>Important notes<\/strong><\/span><\/h3>\n<ul style=\"list-style-position: outside;\">\n<li><span class=\"Apple-style-span\" style=\"line-height: 13px;\">There is NO early registration, only <strong>General<\/strong> and <strong>Final<\/strong> Registration.&nbsp;<\/span><\/li>\n<li>Invitations to compete operate on a first come first serve basis: The <strong>first 20 teams<\/strong> to register during <strong>General<\/strong> Registration will be entered into this year\u2019s competition. The <strong>first 10 teams<\/strong> to register during <strong>Final<\/strong> Registration will be entered in this year\u2019s competition.&nbsp;<\/li>\n<li>USD Appellate Moot Court&nbsp;has the sole discretion to decide whether invitations will be extended during registration and to which schools invitations will be extended. USD Appellate Moot Court also reserves the right not to disclose which teams have been extended invitations.&nbsp;<\/li>\n<\/ul>\n<h3 style=\"margin-bottom: -10px;\"><span style=\"font-size: 14pt; color: #003b70;\"><strong>General Registration<\/strong><\/span><\/h3>\n<p style=\"margin-bottom: 25px;\">You may register <strong>one (1) team<\/strong> beginning on <span style=\"color: #ff0000;\"><strong>July 2, 2020 at 9:00am PST<\/strong><\/span> and ending on <span style=\"color: #ff0000;\"><strong>July 11, 2020 at 11:59pm PST<\/strong><\/span><\/p>\n<h3 style=\"margin-bottom: -10px;\"><span style=\"font-size: 14pt; color: #003b70;\"><strong>Final Registration<\/strong><\/span><\/h3>\n<p style=\"margin-bottom: 25px;\">All schools may register <strong>up to&nbsp;two (2) teams<\/strong>&nbsp;during Final Registration beginning on&nbsp;<span style=\"color: #ff0000;\"><strong>July 18, 2020 at 9:00am PST<\/strong><\/span>&nbsp;and&nbsp;ending&nbsp;on&nbsp;<span style=\"color: #ff0000;\"><strong>July 25, 2020 at 11:59pm PST<\/strong><\/span>. &nbsp;If your school has already registered a team during General Registration, it may register a second team at this time.<\/p>\n<h3 style=\"margin-bottom: -10px;\"><span style=\"font-size: 14pt; color: #003b70;\"><strong>Registration Instructions<\/strong><\/span><\/h3>\n<p style=\"margin-bottom: 25px;\">Complete the Google Form below. Be sure to upload the affidavit provided on the website in the Google Form!<\/p>\n<p><strong>After you have been invited to participate, the competition fee will be due beginning on <\/strong><span style=\"color: #ff0000;\"><strong>August 1 through August 31, 2020<\/strong><\/span>. Previous final round judges include Justices of the Supreme Court of California and the Ninth Circuit Court of Appeals.<\/li>\n<li>If you are interested in serving as a volunteer judge for future tournaments, please e-mail:&nbsp;<span style=\"text-decoration: underline; color: #0074c8;\"><a style=\"color: #0074c8; text-decoration: underline;\" href=\"mailto:usd.judging@gmail.com\">usd.judging@gmail.com<\/a><\/span>&nbsp;<wbr>and provide your contact information, or <span style=\"text-decoration: underline; color: #0074c8;\"><a style=\"color: #0074c8; text-decoration: underline;\" title=\"Attorneys and Judges\" href=\"http:\/\/www.usdmootcourt.com\/opportunities\/attorneys\/\">click here<\/a><\/span> to submit your information via our online system.<\/li>\n<\/ul>\n<h3 style=\"margin-bottom: 0px;\"><span style=\"font-size: 14pt; color: #003b70;\"><strong>Rule Clarification:<\/strong><\/span><\/h3>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">Rule 8(e) shows inconsistent citations to the record\u2014should we cite to the record as &#8220;R at 8.&#8221; or &#8220;R. at 8.&#8221;?<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> Please use &#8220;R. at 8.&#8221;&nbsp; A correction will be made and all teams will be informed.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">Has Parker&#8217;s case gone to trial?&nbsp; There is some confusion over the use of the word &#8220;conviction&#8221; and whether this means Parker was convicted at trial after being denied her motion to suppress, or whether Parker has just been charged and this is an interlocutory appeal before trial.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> Ms. Parker completed her trial, and that the statements made to both Officer Degg and Agent Mulder were used in preliminary hearings as well as at trial.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">Does the problem use &#8220;probable cause hearing&#8221; and &#8220;preliminary hearing&#8221; interchangeably?&nbsp; They are sometimes broken out as two separate phases, such as on page 5 of the record, but then used interchangeably in section II.B of the Fourteenth Circuit opinion on pages 13 and 14 of the record.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> The problem does use the phrases interchangeably, meaning, the implications are the same.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">References to Officer Degg and Agent Degg?<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> The two are the same person.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">Should the citations for the brief be in-text or footnotes? Under Rule 8. it mentions footnotes.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> Citations should be in the text. Footnotes refers to information that the brief writer would see fit to exclude from the main text.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">Is there an open or closed case universe in this competition?<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> The problem is an open universe, in the sense that you are not confined to the cases and law used in the record.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">In the statement of the facts, on page 4 line 5 of the record, it states \u201cParker was placed in an interrogation room at 8 am.\u201d However, on page 25, lines 16 through 23 it indicates that Ms. Parker was placed in a holding cell. Was Ms. Parker placed in an interrogation room the entire time while at the police station or was initially placed in a holding cell for 12 hours and then moved to an interrogation room when Agent Mulder arrived?<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><em>Answer:<\/em> Ms. Parker was placed in an interrogation for the entire time.<\/p>\n<ol style=\"list-style-position: outside;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"list-style-position: outside;\">\n<li style=\"margin-bottom: 0px;\">Once Ms. Parker arrived at the station, where did Officer Degg and then Agent Mulder question her?
